CHARLOTTE, N.C. - Rezul -- Homeowners associations (HOAs) maintain a variety of rules and regulations to protect property value and create an enjoyable community for members. While homeowners generally have control over what they do with their homes, some HOAs have policies in place when it comes to renting out properties. Kuester Management Group has released a statement to the press regarding handling rental requests and implementing restrictions.
"Some homeowners own multiple properties and rent them out for additional income," says Bryan Kuester, President of Kuester Management Group. "While long-term renters can be an integral part of the community, short-term rentals have the potential to cause disruption due to high turnover."
HOAs may consider implementing rental restrictions for a number of reasons, including maintaining property value, minimizing violations, and reducing liability, says Kuester. The association may limit the percentage of homes in the community that can be used as rental properties, or implement a minimum lease period for rentals, such as 30 days.

These types of restrictions can help reduce turnover from short-term rentals where guests are coming for a long weekend or just a week or two. These types of rentals often lead to complaints about noise, traffic, and other community violations because renters are unaware of the rules and expectations of the HOA or choose to disregard them. In turn, the homeowner may be held liable for violations from their renters.
"It is important for the HOA to be open and transparent with homeowners regarding the decision to implement rental restrictions," says Kuester. "Give homeowners the opportunity to voice their opinions and concerns so that the board can create appropriate policies. Discuss why changes are being made and how it can benefit the association and its members. It is also essential to consult with legal counsel regarding local, state, or federal rules around rental restrictions."
