Texas: Governor Abbott Amends, Renews Flooding Disaster Proclamation In October 2025

~ Governor Greg Abbott of Texas has declared a state of disaster in 31 counties due to heavy rainfall and flash flooding that occurred on July 2, 2025. The disaster proclamation was initially issued on July 4, 2025 and has been amended and renewed in subsequent proclamations.

The affected counties include Bandera, Bexar, Burnet, Caldwell, Coke, Comal, Concho, Edwards, Gillespie, Guadalupe, Hamilton, Kendall, Kerr, Kimble, Kinney, Lampasas, Llano, Mason, Maverick, McCulloch, Menard, Real, Reeves,San Saba,Schleicher,Sutton,Tom Green ,Travis,Uvalde,and Williamson.

According to the Governor's office,the heavy rainfall and flooding caused widespread and severe property damage,injury or loss of life in these counties. In response to this disaster,the Governor has invoked his authority under Section 418.014 of the Texas Government Code to declare a state of disaster.

Under Section 418.017 of the Texas Government Code,the Governor has authorized the use of all available resources of state government and political subdivisions to cope with this disaster. This includes any necessary emergency response measures.

In addition,the Governor has suspended any regulatory statutes or orders that may hinder necessary action in coping with this disaster. This includes suspending Sections 264.514 and 264.515 of the Texas Family Code and Articles 49.04 ,49.05 ,49.10 ,and 49.25 of the Texas Code of Criminal Procedure which could prevent the transfer of bodies to families as soon as possible.

Furthermore,the Governor has authorized the suspension of any state statutes or administrative rules regarding contracting or procurement if they impede emergency response efforts by state agencies.

The proclamation also states that copies will be filed with applicable authorities as required by law.

Governor Abbott signed the proclamation on October 19,2025 and it was attested by Secretary of State Jane Nelson. The full proclamation can be viewed on the Governor's website.
