Spokane: Notice of Intent to Make a Section 4(f) De Minimis Impact Determination

~ Spokane Transit Authority Proposes Bus Rapid Transit Project Along Division Street

The Spokane Transit Authority (STA) has announced its plans to construct the Division Street Bus Rapid Transit (BRT) Project, a 10-mile-long corridor project that will run along Division Street in the City of Spokane and parts of unincorporated Spokane County, Washington. The project, which is expected to be completed by 2026, aims to upgrade and replace the existing Route 25 with BRT service, including new stations and roadway modifications.

In order to fund the project, STA intends to apply for federal funds administered by the Federal Transit Administration (FTA). As a result, the project falls under the jurisdiction of Section 4(f) of the Department of Transportation Act of 1966, which requires that any transportation project involving publicly owned land from a significant public park or historic site must undergo a thorough assessment before being approved.

The City of Spokane Parks & Recreation Department owns and maintains two parks along Division Street - Franklin Park and B.A. Clark Park - which are adjacent to improvements being made as part of the BRT Project. These parks currently have existing STA bus stops that will be upgraded to BRT stations.

According to Section 4(f) requirements, FTA cannot approve a transportation project that requires the use of any publicly owned land from a significant public park or historic site unless it is determined that there is no feasible and prudent alternative and all possible measures have been taken to minimize harm to the property. Alternatively, if there is no other option available, the impact on the resource must be deemed de minimis - meaning it will have no adverse effect on its activities or features.

In this case, improvements at B.A. Clark Park will require a temporary construction easement and permanent right-of-way acquisition totaling approximately 380 square feet. This action will need approval from the Park Board Lands Committee. Meanwhile, improvements at Franklin Park will only require a temporary construction easement of 32 square feet, which can be completed administratively and approved by the Director of Parks and Recreation.

To assess the potential environmental and community impacts of the project, STA has issued a technical memorandum entitled "Division Street Bus Rapid Transit Property Acquisition and Section 4(f)/6(f) Technical Memorandum." The assessment concluded that the project is expected to have minimal impacts on property acquisitions, displacements, and Section 4(f)/6(f) resources. Based on this assessment, FTA intends to make a de minimis impact determination for B.A. Clark Park.

The City of Spokane, in coordination with STA and FTA, intends to concur with this determination and grant the requested easements and/or acquisition. However, members of the public who wish to comment on this decision have 14 days from the date of this notice to do so. Comments can be submitted via mail or email to the Parks & Recreation department.
