Phoenix REALTOR® Jennifer Alvarez Highlights Real Estate Challenges When Co-Owners Disagree About Selling
Rezul News/10748280
PHOENIX - Rezul -- Selling a home is rarely simple when the people who own it no longer agree on what should happen to the property. For unmarried couples, family members, heirs, former partners and other co-owners, a disagreement over whether—or how—to sell can turn an ordinary transaction into a complicated legal and financial matter.
Phoenix REALTOR® Jennifer Alvarez, a former paralegal with more than 20 years of legal-industry experience and a court-appointed Real Estate Special Commissioner in Maricopa County, says these situations often require a different approach from a conventional home sale.
"When everyone agrees on the objective, the real estate process is relatively straightforward," Alvarez said. "When owners disagree about whether to sell, what the property is worth, how it should be prepared or even who should communicate with the real estate agent, the transaction can become much more complicated."
Disputes between co-owners can arise in many circumstances. A property may have been purchased by an unmarried couple whose relationship has ended. Family members may inherit real estate together but have different financial goals. Business partners or investors may disagree about whether to continue holding an asset. In some cases, one owner wants to sell while another does not.

When owners cannot resolve those disagreements voluntarily, legal proceedings—including a partition action in appropriate circumstances—may become part of the process. Alvarez emphasizes that legal questions belong with the parties' attorneys, while the real estate professional has a separate role once a property must be evaluated, prepared, marketed or sold.
"The Realtor should not be trying to resolve the legal dispute," Alvarez said. "Our job is to provide reliable real estate information, communicate professionally with the appropriate parties and keep the property transaction moving without adding to the conflict."
Clear communication and a realistic market strategy are particularly important when attorneys, court orders or multiple decision-makers are involved.
"A house doesn't know why its owners are fighting," Alvarez said. "Buyers are still going to respond to price, condition, presentation and the market. Keeping the real estate strategy grounded in those facts can be extremely valuable when everything surrounding the transaction feels contentious."
