THE VILLAGES, Fla. ~ In a recent press conference, Governor Ron DeSantis of Florida announced a new proposal aimed at protecting consumers and their rights in the rapidly growing field of artificial intelligence (AI). The proposal includes the establishment of an Artificial Intelligence Bill of Rights for citizens, as well as measures to prevent Floridians from bearing the financial burden of Hyperscale AI Data Centers and to give local governments the power to reject their development in their communities.

Governor DeSantis stated, "Today, I proposed new legislation on artificial intelligence and AI data centers to protect Floridians' privacy, security, and quality of life." He emphasized the need for safeguards in this emerging technology and outlined the key components of his proposal.

The first aspect of the proposal is the establishment of an AI Bill of Rights, which will provide consumers with protections against potential abuses by AI systems. This includes reenacting existing protections against "deep fakes" and explicit material, particularly those depicting minors. The proposal also prohibits any state or local government agency from using Chinese-created AI tools such as DeepSeek to protect American data.

Furthermore, the proposal aims to protect individuals' rights over their own personal information by prohibiting AI from using an individual's Name, Image, or Likeness (NIL) without their consent. This provision would tie any unauthorized use to harm or sale of a product, such as political ads or schemes to defraud. Additionally, companies utilizing AI must provide a notice to consumers when interacting with them through chatbots.

The proposal also addresses concerns about the use of AI in mental health counseling. It prohibits entities from providing "licensed" therapy or counseling through artificial intelligence and allows for parental controls for minors using large language models. This would enable parents to access their child's conversations with AI systems, set parameters for when they can access these platforms, and receive notifications if concerning behavior is detected.

Governor DeSantis also emphasized the importance of ensuring the security and privacy of data inputted into AI systems. The proposal includes measures to prevent companies from selling or sharing personal identifying information with third parties and mirrors existing data privacy protections in current law.

In addition to protecting consumers' rights, the proposal also addresses concerns about the development of Hyperscale AI Data Centers. These centers, which require large amounts of energy and resources, have raised concerns about their impact on local communities and natural resources.

To address these concerns, the proposal prohibits utilities from charging Florida residents more to support hyperscale data center development. It also prohibits taxpayer subsidies for Big Tech companies and gives local governments the power to prohibit data center construction or development. The proposal also aims to protect Florida's water resources by ensuring they are not utilized to the detriment of the public.

Furthermore, the proposal seeks to preserve natural Florida by preventing the construction, siting, or operation of a data center by foreign principals or on land classified as agricultural or under a greenbelt exemption. It also requires noise abatement reviews by the Florida Department of Transportation to protect natural areas from noise pollution.

Governor DeSantis's proposals have been met with support from consumer advocacy groups and local government officials who see it as a necessary step in protecting Floridians' rights and resources in an increasingly AI-driven world. The legislation will now go through further review and consideration before potentially becoming law.
