Chicago: Mayor Brandon Johnson Signs 'ICE On Notice' Executive Order, Directing CPD To Document Misconduct And Pursue Prosecution Of Federal Agents

CHICAGO ~ Chicago Mayor Takes Stand Against Federal Immigration Agents

In a bold move, Chicago Mayor Brandon Johnson has signed an executive order known as 'ICE On Notice', directing members of the Chicago Police Department (CPD) to investigate and document any alleged illegal activity by federal immigration agents. The order also calls for evidence of felony violations to be referred to the Cook County State's Attorney's Office for prosecution.

During a press conference, Mayor Johnson stated, "Nobody is above the law. There is no such thing as 'absolute immunity' in America. The lawlessness of Trump's militarized immigration agents puts the lives and well-being of every Chicagoan in immediate danger." He went on to say that with this order, Chicago is putting ICE on notice and will not sit idly by while federal agents terrorize residents.

This executive order, numbered 2026-01, creates a framework for public accountability in the event that federal agents violate local or state law while operating in Chicago. It makes Chicago the first city in the nation to use local authority to pursue legal accountability for misconduct by federal immigration agents.

The mayor's order comes in response to reports of federal immigration operations that have violated constitutionally protected rights, destabilized communities, and provoked life-threatening confrontations while remaining insulated from local or civilian oversight. It provides a clear procedure for CPD to follow if they witness or receive reports of illegal activity by federal agents.

According to the order, if CPD personnel observe or receive reports of apparent violations of state or local law by federal agents, they are required to document these activities according to CPD policy. They must also ensure that any body-camera footage captured during the incident is preserved and seek to identify and record information about the supervisory officer on scene.

In cases where there is evidence of illegal misconduct by federal immigration agents, CPD supervisors will preserve evidence and make a referral of felony matters to the Cook County States Attorney at the direction of the Mayor's Office. Additionally, CPD will share aggregated data on documented legal violations by federal immigration officers with the public.

This executive order comes at a critical time, as reports have surfaced that the federal government is planning another immigration surge in Chicago and the surrounding area later this spring. Mayor Johnson's call for prosecution follows the absence of legal repercussions in previous cases, such as the shooting of Marimar Martinez in Chicago and the killings of Silverio Villegas González in Franklin Park and Renee Good and Alex Pretti in Minneapolis.

Mayor Johnson's actions have been met with support from a nationwide coalition of local leaders and prosecutors who are also working to hold Immigration and Customs Enforcement (ICE) and Customs and Border Patrol (CBP) agents accountable in their own cities. District Attorney of Philadelphia, Larry Krasner, stated, "I applaud Mayor Brandon Johnson's bold and principled leadership in building the infrastructure to hold ICE and CBP agents accountable for criminal misconduct."

In recent news, a federal judge in Minnesota identified 96 court orders that ICE agents have violated since January 1, 2026. During their operation in Chicago last fall, immigration agents ignored federal court orders limiting use of force during enforcement.

In consultation with Corporation Counsel and the Mayor's Office of Immigrant Migrant and Refugee Rights, CPD will issue guidance and establish procedures for implementing the requirements of this order within 30 days. The signed Executive Order will also be posted on the City Clerk's website for public access.

Mayor Johnson's executive order sends a strong message that Chicago will not tolerate illegal activity by federal immigration agents within its borders. It sets an example for other cities to follow in holding these agents accountable for their actions.
