TALLAHASSEE, Fla. - Rezul -- Siri Properties, LLC is calling for stricter enforcement of 'verified standing' in Florida homeowners' association petitions, following a formal public comment filed with the Florida Division of Condominiums, Timeshares, and Mobile Homes. The filing argues that a corporate name alone does not grant an association the legal power to negotiate on behalf of a community under the Florida Mobile Home Act (FMHA).
According to Florida Statute § 723.075, an association's representative power is contingent upon securing the written consent of a 51% majority of homeowners. Siri Properties contends that without this verified mandate, any legal agreements or changes to a community's Prospectus arising from unauthorized representation are "facially voidable," which could create a "cloud on the title" for residents' leasehold interests.

"Following the 51% rule isn't just about paperwork; you need a body that's been officially recognized to act as the homeowners' official voice," said a spokesperson for Siri Properties, LLC. "We believe that for a community's voice to be truly powerful, it has to be legally sound."
The challenge also highlights a regulatory gap: organizations identifying as "social clubs" in federal IRS filings while claiming fiduciary status in Florida state petitions.
